GLSP's Education Cases Keep Kids in School
Eric is ten years old and in the 3rd grade. He repeated Kindergarten on two occasions. Eric suffers from congenital hydrocephalus associated with developmental delay. Eric's learning disabilities make him at high risk for school failure. During the 2002-03 school year, Eric was evaluated by the school and determined ineligible for special education services. Eric's mother was not informed of her parental rights provided by the Individuals with Disabilities Education Act and Section 504 of the Rehabilitation Act of 1973. Eric's mother contacted GLSP for help. A GLSP lawyer filed a complaint with the United States Department of Education, Office for Civil Rights against the school system. GLSP's legal assistance resulted in Eric being evaluated for special education services and the school developing an Individualized Educational Plan for Eric. The school also agreed to abide by the requirements of applicable federal laws and provide parents with notices of their procedural safeguards in future cases.
